Abstract

International human rights law has devoted the right to higher education in many international and regional instruments, and has highlighted the importance of the right to higher education for the individual and society. Therefore, the nature of States parties obligation towards the right to higher education is immediate and gradual at the same time, States’ violation or neglect of this right is tantamount to relinquishing the State’s obligation to its own will, gives the victims of the right to education the right to defend their rights by means of the law, at the local level first, then at international one in case of the law, at the local level first, then at the international one in case of non-respond of National authorities
